These terms govern your access to and use of TrackWhy (the “Service”), operated by [Company legal entity]. By creating an account or using the Service, you agree to these terms. If you are using TrackWhy on behalf of an organization, you accept these terms on its behalf.

You must provide accurate information when you register and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be legally able to enter into this agreement to use the Service.
You agree not to misuse the Service. That includes not using it to collect personally identifiable information through custom events, not attempting to breach or probe our security, not reselling or reverse-engineering the Service, and not using it for any unlawful purpose or in a way that disrupts the Service for others. You are responsible for the data you send to TrackWhy and for having the right to process it.
TrackWhy is offered on a single paid plan, billed monthly or annually. New accounts start with a 14-day free trial; no payment card is required to begin. If you do not subscribe by the end of the trial, data collection may be paused or your account limited until you do.
Paid subscriptions renew automatically at the end of each billing period until cancelled. Payments are processed by Stripe. Fees are charged in advance and are non-refundable except where required by law. We may change pricing on renewal with reasonable notice; any founder or early-supporter pricing you lock in is honored as described at the time of purchase.
You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then, and we do not pro-rate partial periods unless required by law.
We work hard to keep TrackWhy fast and available, but the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that analytics figures will be free of all inaccuracy.
To the maximum extent permitted by law, [Company legal entity] will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms, fail to pay, or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends and we may delete your data in accordance with our Privacy Policy.
We may update these terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify account holders. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
These terms are governed by the laws of [Governing jurisdiction], without regard to its conflict-of-laws rules. The courts of [Governing jurisdiction] have exclusive jurisdiction over any dispute arising from these terms, except where mandatory local law provides otherwise.
